Clery Act Explained: Rights, Responsibilities, and Compliance Guidelines
Pursuant to the “Jeanne Clery Disclosure of Campus Security Policy and Crime Statistics Act” (previously known as the Federal Student Right-To-Know and Campus Security Act of 1990) colleges and universities receiving federal funds are required to notify community members who is considered a “campus security authority.”
Campus Security
The U.S. Department of Education defines a campus security authority as (1) A campus law enforcement unit; (2) An individual or organization specified in an Institution’s statement of campus security policy as the individual or organization that has significant responsibility for student and campus activities, but does not have significant counseling responsibilities.
ABC does not have a campus law enforcement. Law enforcement is provided by the Palmer Police and/or Alaska State Troopers. ABC refers all parties interested in reporting off-campus crimes or seeking off-campus crime statistics to the Palmer Police Department, located near the campus and quadplex, at 423 S. Valley Way, Palmer, Alaska.

Title IX
Title IX at a Glance: Ensuring Equity, Preventing Discrimination, Protecting Students
In accordance with Title IX of the Education Amendments of 1972 and 34 C.F.R. Part 106, Alaska Bible College (ABC) does not discriminate on the basis of sex in its educational programs, activities, or employment. ABC prohibits all forms of sex-based harassment, including sexual harassment, sexual assault, dating violence, domestic violence, and stalking.
No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance. — 20 U.S.C. § 1681
This policy applies to students, employees, applicants, and third parties, regardless of sex. ABC is a faith-based institution and may exercise religious exemptions consistent with federal law.
Grievance Procedures
Alaska Bible College has adopted a formal grievance process that complies with Title IX regulations. The following procedures apply to allegations of sexual harassment as defined by federal law:
1. Reporting
Anyone may report sexual harassment or discrimination to the Title IX Coordinator in person, by mail, email, or by phone.
Reports may be submitted at any time, including outside normal business hours.
2. Supportive Measures
Upon receipt of a report, the College will promptly contact the complainant to:
· Discuss the availability of supportive measures (with or without a formal complaint),
· Consider the complainant’s wishes regarding these measures,
· Explain the formal complaint process.
3. Filing a Formal Complaint
A formal complaint is a written document filed by a complainant or signed by the Title IX Coordinator requesting an investigation into sexual harassment under Title IX.
4. Investigation
If a live hearing is used (per institutional policy), it will include:
· A neutral decision-maker,
· Opportunity for cross-examination through advisors,
· Protections for relevance and privacy.
If no live hearing is used, a written question process will apply.
5. Hearing or Determination Process
If a live hearing is used (per institutional policy), it will include:
· A neutral decision-maker,
· Opportunity for cross-examination through advisors,
· Protections for relevance and privacy.
If no live hearing is used, a written question process will apply.
6. Written Determination
The decision-maker will issue a written determination of responsibility, including:
· Findings of fact,
· Policy conclusions,
· Sanctions (if any),
· Remedies for the complainant,
· Appeal procedures.
Both parties will receive the outcome simultaneously.
7. Appeals
Each party has the right to appeal based on:
· Procedural irregularity,
· New evidence,
· Conflict of interest or bias.
Appeals are reviewed by a separate appeal officer.
8. Informal Resolution
After a formal complaint is filed, parties may agree to resolve the matter through informal resolution. This is:
· Voluntary,
· Facilitated by a trained staff member,
· Not available for student complaints against employees.
9. Retaliation Prohibited
ABC prohibits retaliation against any individual for reporting, participating in, or refusing to participate in a Title IX process. Retaliation will be addressed promptly.
Religious Exemption
As a Christian institution, Alaska Bible College operates in accordance with its doctrinal beliefs and reserves the right under 20 U.S.C. § 1681(a)(3) and 34 C.F.R. § 106.12 to claim exemption from specific Title IX provisions that conflict with those beliefs.
The College’s religious values do not affect its commitment to provide a safe and respectful environment for all students and employees.
